Uniform Electronic Transactions Act (UETA) Agreement
Effective Date: September 1, 2024
This Uniform Electronic Transactions Act Agreement ("Agreement") outlines the terms and conditions under which America West Placement and you, the user, consent to the use of electronic signatures, electronic records, and electronic communications in all transactions between you and America West Placement.
1. CONSENT TO USE OF ELECTRONIC RECORDS AND SIGNATURES
By agreeing to this Agreement, you consent to the use of electronic records and signatures as provided by the Uniform Electronic Transactions Act (UETA). You acknowledge that electronic signatures carry the same legal weight and effect as handwritten signatures.
2. SCOPE OF AGREEMENT
This Agreement applies to all electronic transactions, including but not limited to:
- Authorizations, agreements, contracts, and disclosures
- Invoices, receipts, and other payment documents
- Notices, policies, and communications related to services provided by America West Placement
3. RIGHT TO WITHDRAW CONSENT
You have the right to withdraw your consent to conduct transactions electronically at any time. To withdraw your consent, you must notify us in writing at support@americawestplacement.com. Withdrawal of consent will not affect the legality or enforceability of prior transactions or communications conducted electronically.
4. HARDWARE AND SOFTWARE REQUIREMENTS
To access and retain electronic records, you must have:
- A device (computer, tablet, smartphone) with internet access
- A web browser that supports secure communications (e.g., Chrome, Firefox)
- Software capable of opening PDF files (e.g., Adobe Acrobat Reader)
- A valid email account
5. PAPER COPIES
You may request a paper copy of any electronic record by contacting us at support@americawestplacement.com. We reserve the right to charge a fee for providing paper copies.
6. UPDATING CONTACT INFORMATION
It is your responsibility to provide accurate and current contact information. You must notify us of any changes to your email address or other contact information by contacting support@americawestplacement.com.
7. YOUR AFFIRMATIVE CONSENT
By selecting "I agree", you affirmatively consent to conduct business electronically with America West Placement, and its business associates. You confirm that you have access to the necessary hardware and software to read, review, and retain electronic records.
8. LEGAL EFFECT
This Agreement is governed by the Uniform Electronic Transactions Act (UETA) and ensures that electronically signed documents will be legally binding, just as if they were signed with a physical signature.
